My retaining wall fell 20 feet up my driveway from the entrance. I called my insurance company and was told that there isn’t a lot they can do.

 

So I called the town to see who built it and the old homeowner did 4 years ago! With no contractor! And the building department passed it for inspection.

 

There is no geo grid, no drainage, and dirt as a backfill. I bet you I can pull the rest down by hand.

 

My question is who is responsible? This is not right.

Another? Excuse me? If the building department passed it and it fails. You would think the building department didn’t inspect it

Even if the wall was inspected @06kfx440 by the town that does not cover the surrounding grounds.  It could have been a number of circumstances that led up to the wall coming down. Tree roots expanding, untraditional rains we have been experiencing over the last few years, shifting grounds it could be so many things. 

I would think homeowners insurance would be the route to go on this.

I would agree with @Frank Angerano, homeowners insurance. The town or previous owner bear no responsibility. When you buy property here in NY for instance, its as is, and the buyer usually gets a home inspection prior to purchase. If something comes up, its a negotiating tool. There are instances of transferable warranties like on roofs, appliances, etc.

@Freezeman I have to say it’s a little bit out of line brother. All he did was simply ask a question.  There are a ton of people out there that are always looking for a break. Not @06kfx440 !

I can personally tell you I’ve rode with him and also met his kids as well as some of his friends,  he’s a good man. I actually caught up with him last week in the city for a few cold ones. He is not looking for anything free by far!
